The 2023 Great Golden Contest
Official Contest Rules (the “Rules”)
- CONTEST PERIOD
The Contest commences on Monday, September 18, 2023 @ 9:00 AM ET and continues until Friday, September 29, 2023 at 11:59 PM ET (the “Contest Period”). All entries must be received by 11:59 PM ET on Friday, September 29, 2023 (the “Contest Closing Time”). Attempts to add Golden Nugget entries after the Contest Closing Time will not be accepted.
- CONTEST ELIGIBILITY
The Contest is open to Canadian Residents (including Quebec) who have reached the age of majority in their province of residency and have entered a Golden Nugget Clue during the two (2) week Contest Period. If you are under the age of majority in the province/territory in which you reside at the time of the Contest Period, you may still participate in this Contest. However, a parent or legal guardian of a minor must be the person named on the Official Online Entry Form, correctly answer a mathematical skill-testing question and execute all release form(s) on behalf of such a minor participant. Not Eligible: (a) employees, directors, officers, representatives and agents of: (i) ParticipACTION or Yukon Government – The Department of Tourism and Culture (ii) the independent contest management organization(s) appointed by the Sponsors to administer the Contest (the “Contest Administrator”); (iii) any affiliates of the Sponsors or the Contest Administrator; (iv) any of the Sponsors advertising, promotion and fulfillment agencies involved in the development or execution of the Contest in any way; and (v) any persons or entities involved in judging the Contest; and (b) all persons with whom those specified in (a) are domiciled or immediately related. The persons and entities specified in (a) and (b) are referred to collectively herein as the “Contest Entities”. For the purposes of these Rules, two people are “immediately related” if one is the husband, wife, spouse, common-law partner, son, stepson, son-in-law, daughter, stepdaughter, daughter-in-law, sister, stepsister, sister-in-law, brother, stepbrother, brother-in-law, mother, stepmother, mother-in-law, father, stepfather or father-in-law of the other. For clarity, groups, clubs, organizations, businesses and commercial and non-commercial entities cannot enter the Contest.
- GRAND PRIZE
One (1) Grand Prize* consisting of one (1) Gold Coin with a retail value of $3,999.95 (face value of $200.00) will be awarded in this Contest. *Note: Restrictions apply to the Grand Prize Award: Awarding the Grand Prize in this contest is subject to verification of eligibility and compliance with the terms of these Contest Rules. Prizes must be accepted as awarded and are non-transferable, and no substitution will be made except as provided herein at the Sponsors sole discretion. The Sponsors reserve the right to modify and/or substitute a prize or component of a prize for one of comparable or greater value. The winner is not entitled to the monetary difference between the actual prize value stated and the approximate prize value, if any. The Grand Prize winner is responsible for all costs, taxes and other fees associated with the Grand Prize receipt and/or use. All Grand Prize details are at the Sponsors sole discretion. The estimated Grand Prize value is in Canadian dollars at the time of purchase unless otherwise stipulated. To be confirmed as the Grand Prize winner in this contest, the selected entrant must accurately complete a mathematical skill-testing question and fully complete the Contest Release and Indemnity Form. Additional terms, conditions and restrictions may apply to a prize or component of a prize. The Sponsors will have no liability to a Participant who is unable to take part in any part of the Contest, collect Golden Nuggets or accept a prize for any reason whatsoever. There is no obligation on the part of the Sponsors to record or broadcast the appearance or participation of any participant in connection with the Contest. **Note: The retail value of the gold coin at the time of purchase is $3,999.95, the face value of the coin is $200. - HOW TO ENTER AND COLLECT GOLDEN NUGGETS – NO PURCHASE NECESSARY
Contest Entry: To begin your career as an explorer and collect Golden Nuggets (the “Contest Entries”) during the Contest Period, fully complete the Official Contest Entry Form, enter in one Golden Nugget, and acknowledge that you have read, understood and comply with the Official Contest Rules by clicking the appropriate check box. The Official Contest Entry form can be found by navigating to https://www.participaction.com/great-golden-contest/ on your preferred internet browser. Both mobile and PC are supported. Registering using this form creates an interactive entry form that allows you to collect and record all Golden Nuggets you find (One (1) Golden Nugget = One (1) Contest Entry). Golden Nuggets Defined: A Golden Nugget is a word or phrase that is hidden in a piece of content on ParticipACTION and Travel Yukon’s websites or social media accounts (Facebook, Instagram and Twitter/X). Collecting Golden Nuggets: Find Golden Nuggets across ParticipACTION and Travel Yukon’s website or social media accounts (Facebook, Instagram and Twitter/X). There are six (6) Golden Nuggets to be found across the participating digital assets of the Sponsors. There are two (2) primary ways to find the clues and collect Golden Nuggets:
- Each Monday, Wednesday and Friday of the Contest Period, entrants will visit the Great Golden Contest webpage for a list of the locations to find the Golden Nugget.
- Visit ParticipACTION’s Facebook, Instagram and Twitter/X accounts every Monday, Wednesday and Friday during the Contest Period for details on where to find the Golden Nugget.
For each Golden Nugget you find and register during the Contest Period, you will receive one (1) entry into the Contest. There will be additional social actions that can earn you bonus entries. These will be listed on the Entry Form.
- GRAND PRIZE WINNER SELECTION
A draw for the Grand Prize will be made by a random computer-generated selection process in Toronto, Ontario, by the Sponsors or their designated representative, on Tuesday, October 3, 2023 at approximately 11:00 AM ET from all eligible entries received as of the Contest Closing Date. The selected Eligible Entrant will be contacted by telephone or email provided at the time of Contest Entry by the Sponsors or their representative. If, after three (3) attempts, within a period of five (5) business days, the Sponsors or their representative are not able to contact the potential Grand Prize winner or the selected entrant has not responded to the Sponsors notification of the entrant’s selection within twenty-four (24) hours of the last notification communication, or if the potential Grand Prize winner is disqualified for any reason, the potential Prize winner shall forfeit the Grand Prize, without any recourse to the Sponsor or its advertising agencies, and the Sponsors may select, by random draw, an alternate potential Grand Prize winner from among all remaining eligible entries. The selected entrant will be required to accurately complete a time-limited mathematical skill-testing question and to sign a form of Declaration and Release (the “Release Form”) or otherwise confirm compliance with the Rules, acceptance of the Prize as awarded, without substitution, and release the Sponsors, their dealers, agents, affiliated and related companies, advertising and promotional agencies, the independent judging organization and their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively, the “Releases”) from any liability arising out of or in any way connected with the operation of this Contest and use of the Prize. The Prize winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of the Prize and from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the entry. The Release Form must be returned within five (5) business days or the Prize may be forfeited. Upon receipt of the completed Release Form, the Sponsors, or their representative, will inform the winner of details related to how the winner will receive the Prize. Failure to comply with any or all of the above conditions will result in disqualification, and you will no longer be eligible to win the Grand Prize in this contest. This process will be repeated until such time that a Grand Prize winner is declared in this contest.
- GENERAL RULES
The winner of the Grand Prize is subject to verification by the Sponsors and/or their designated representatives. Entries made with multiple addresses, under multiple identities, through the use of any device or artifice to enter multiple times or entries that are in excess of the permitted number of entries for the Contest Period are automatically void. All entries or accumulation of Golden Nuggets through unauthorized sources, copied from sources subject to copyright laws, or otherwise deemed by the Sponsors to be illegible, mutilated, altered, reproduced, forged or irregular in any way, are automatically void. The Sponsors will be the sole and final reference source in validating the Grand Prize claim. Disputes: If a dispute arises regarding who submitted an entry, the entry will be deemed to be submitted by the individual who is the rightful owner of the email provided at the time of entry. For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement. Limitation of Liability: The Sponsors are not responsible for: system/process failures of any kind, including but not limited to: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Contest; (iv) electronic or human error which may occur in the administration of the Contest or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to the entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Contest. Release: By entering the Contest, each entrant hereby grants to the Sponsors the unlimited right (but not the obligation) to publish and use, without payment or other compensation and without notice, consent or approval, his/her name, photograph and likeness, address (city/town, province or territory), voice, and the whole or part of any statement or statements he/she has made or makes about the Contest or Grand Prize awarded in any publicity, program or advertising, without geographic limit and in perpetuity, in any medium now known or hereafter devised (including, without limitation, the Internet), and hereby consents unconditionally to any such publication or use without further notice, consent, approval or compensation. Property: All entries become the permanent property of the Sponsors and none will be returned. No correspondence will be entered into, except with the selected Grand Prize entrant. The Contest is subject to all applicable Canadian federal, provincial and local laws and regulations. This Contest is VOID WHERE PROHIBITED BY LAW AND IS EXPRESSLY NOT OPEN TO PARTICIPATION BY RESIDENTS OF ANY JURISDICTION OTHER THAN CANADA. Decisions of the Sponsors: The decisions of the Sponsors in relation to this Contest will be final and binding on all Contest entrants, subject to what is otherwise provided in these Rules. The Sponsors shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost / delayed / incomplete / interrupted / misdirected / stolen / illegible / deleted data / network transmissions, line failures of any telecommunication network, failure of computer equipment, software, websites, inability to access any online service or website, inability to submit the Entry or any other malfunction or human or technical error, or any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest, or for late, lost, stolen, postage due, illegible, undelivered or misdirected entries. The Sponsors reserves the right to cancel, terminate or suspend this Contest, at their sole discretion, in the event of a technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the administration, security, fairness or normal operation of the Contest. The Sponsors reserve the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Rules, or as a result of technical problems, or in light of any other circumstances, which, in the opinion of the Sponsors, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules. The Contest is subject to all Federal, Provincial and local laws, as well as the rules adopted in view of said laws. All issues and questions concerning the construction, validity, interpretation and enforceability of the Rules or the rights and obligations as between the entrant and the Sponsors in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. Privacy: The Sponsors respect your right to privacy and work at all times to comply with all applicable data protection and privacy laws. Except as expressly set out in these Rules, in Sponsors Privacy Notice (available at https://www.participaction.com/privacy-policy/ and https://www.travelyukon.com/en/privacy-policy), or as otherwise agreed to by the entrants, any personal information provided in connection with this Contest will only be collected, used and disclosed by Sponsors and its third party partners and service providers for the purposes of administering and conducting this Contest, including, without limitation, verification of eligibility and identity and awarding and delivering Prizes. Language: In the event of any discrepancy or inconsistency between the English language version and the French language version of these Rules, as applicable, the English version shall prevail, govern and control.
